Agreement to these terms

These Terms of Service ("Terms") govern access to and use of Callmart, a pay-per-call marketplace operated by SyncedUp Solutions LLC ("Callmart," "we," "us," or "our"), including the marketing site at callmart.io, the platform at app.callmart.io, and the Callmart mobile app (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms on behalf of yourself and the business you represent.

Eligibility

Callmart is a business-to-business service. It is not available to consumers acting for personal, household, or family purposes. You may use Callmart only on behalf of a business, and you represent that you are authorized to bind that business to these Terms and that the business is lawfully permitted to buy or publish the type of calls it transacts on Callmart.

Accounts and security

You are responsible for the accuracy of the information you provide when creating an account and for keeping your login credentials confidential. You must notify us promptly at support@callmart.io if you suspect unauthorized access to your account. Callmart supports optional two-factor authentication, and we recommend enabling it, particularly for accounts with administrator or billing access.

Workspaces and roles

An organization on Callmart may invite team members and assign them roles, such as buyer, agency administrator, or publisher. The organization is responsible for the actions its members take under its account, including calls purchased, credit spent, and destinations configured. Removing a member’s access is the organization’s responsibility and takes effect once processed on the platform.

The marketplace: buyers and publishers

Callmart connects buyers, who purchase inbound calls, with publishers, who deliver those calls. A buyer configures the campaigns, geographies, and destinations it wants; a publisher offers calls that match those criteria; Callmart facilitates the connection and records the resulting call for billing and dispute purposes.

Publishers are responsible for the legality of how they generate and route calls into the marketplace, including obtaining any consent required before a call is placed. Buyers are responsible for how they handle and act on calls once delivered, including their own compliance obligations as the receiving business. Callmart is the marketplace connecting the two; it is not a party to the underlying transaction between a publisher’s traffic source and the person on the call.

Prepaid wallet and billing

Buyers fund a prepaid wallet before receiving calls. Funds added to your wallet are prepayments for call delivery services on the Service, not a deposit, gift card, or stored-value instrument for any other purpose. Wallet funds are non-transferable between organizations and may not be redeemed for cash except as required by law.

Promotional credits that Callmart applies to a wallet are not withdrawable, are not redeemable for cash, and may expire or be revoked if the account is found to violate these Terms.

We charge your wallet for calls that are delivered and accepted according to the duration and contract terms configured for that campaign. If your wallet balance is insufficient, call delivery to your account will pause until it is refunded. Refunds of unspent wallet balance are handled on a case-by-case basis consistent with a prepaid business balance; contact support@callmart.io to request one.

Buffers and disputes

Campaigns may configure a buyer buffer, a short window at the start of a call during which the buyer can decline the call before it is billed. Calls accepted past that window are considered delivered and billable.

If you believe a call was billed in error, misrouted, or did not meet the campaign’s stated criteria, submit a dispute through the platform or to support@callmart.io within a reasonable time after the call. We investigate disputes using the call detail record and, where available, the recording, and will adjust the ledger with a compensating entry if the dispute is valid. Because our ledger is append-only, corrections are recorded as new entries rather than by altering the original record.

Publisher and buyer obligations

Publishers must only offer calls they are authorized to deliver, must not misrepresent a campaign’s source or quality, and must maintain the technical integrations, including SIP credentials and reservation windows, that the marketplace requires for reliable call delivery.

Buyers must configure accurate destinations, keep their contracted terms (duration, exposure limits, and buffers) current, and use calls received through the marketplace for legitimate business purposes consistent with the campaign they configured.

Telephony compliance

Calls delivered through Callmart are subject to the Telephone Consumer Protection Act, applicable state telemarketing and do-not-call laws, and call-recording consent laws. Publishers are responsible for obtaining any consent required before generating or connecting a call, and for honoring do-not-call requests from the traffic they control.

Calls delivered through the marketplace may be recorded for dispute handling and quality review, as described in our Privacy Policy. Where recording consent from a party on the call is legally required, the party responsible for connecting that leg of the call is responsible for obtaining it. Buyers and publishers are each responsible for their own compliance with the telephony and marketing laws that apply to their side of the transaction.

Acceptable use

You may not use Callmart to transmit unlawful, fraudulent, or deceptive calls; to violate any party’s privacy or consent rights; to interfere with or disrupt the Service or its telephony infrastructure; to circumvent wallet billing; or to access another organization’s data without authorization. We may investigate suspected violations and take action, including suspending delivery, to protect the marketplace.

Suspension, termination, and account deletion

We may suspend or terminate access to the Service if you violate these Terms, if we reasonably believe your account poses a legal, security, or fraud risk to the marketplace, or if required by a telephony or payment partner. We will make reasonable efforts to notify you of the reason where legally permitted.

You may close your account at any time. In the Callmart iOS app, open More, then Account, then Delete account; on the web, use app.callmart.io/security. Any unspent, non-promotional wallet balance will be handled per the refund process described above before the account is closed. Ledger and call records required for accounting, tax, or dispute purposes may be retained after closure as described in our Privacy Policy.

Disclaimers

The Service is provided "as is" and "as available." Callmart does not guarantee call volume, call quality, uninterrupted availability, or that any particular campaign or publisher will meet your business needs. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Callmart will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to Callmart in the three months before the claim arose.

Indemnification

You agree to indemnify and hold Callmart harmless from any claim, loss, or expense, including reasonable attorneys’ fees, arising from your use of the Service, the calls you publish or buy through it, or your violation of these Terms or applicable law.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

If a dispute arises, please contact us first at support@callmart.io so we can try to resolve it informally. If we cannot resolve a dispute informally within 30 days, either party may choose to resolve it through binding arbitration administered under the rules of the American Arbitration Association, seated in Broward County, Florida, instead of going to court. Arbitration is optional, not mandatory: if neither party elects arbitration, the dispute may instead be brought in the state or federal courts located in Broward County, Florida, and both parties consent to the personal jurisdiction of those courts. Either party may always bring an individual claim in small claims court instead of arbitration.

Changes to these terms

We may update these Terms as the Service evolves. If we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you through the platform or by email. Continuing to use Callmart after a change takes effect means you accept the updated Terms.
